    Council cant fine you for it only the police can. Don't drink in the CBD, near public transport, like train station car parks, or bus stops, the foreshore right around the bay, are a few of the places I know you definitely can't drink in public, or possess an open container of intoxicating liquor.     In the ACT the driver can consume alcohol while driving, as long as they aren't over the limit this is fromthe SIL, who is a traffic cop here. Although if you are drinking from a bottle with a cap, screwing the cap back onto the bottle will constitute the bottle as being unopened.     I drank a beer tonight and I was a passenger, and Ive done it while driving too. Oh I'm such a bad ass. An old work mate of mine was charged with street drinking whilst drinking in the car. He was the driver and had only had less than half the beer and couldn't be charged with dd so was done for street drinking. What they aren't driving so why not? LOL coffee is probably banned too. You may drop it and burn yourself! The government and police are just out there to help keep us safe, they care about you!

    Australia has no laws on such things. I'm not aware of any such law in WA. Not even for the driver. Of course you could be charged with a less specific offence, careless, or not keeping both hands on the wheel. I think this is possibly one of those rules where it depends on the cop, so it isn't really strict, but it's not something you should do much. Open container in a car, automatic DUI for the driver.

Watching american cop shows, I've seen shows where cops have charged the driver for DUI when he isn't even driving just sitting in the drivers seat or keys aren't even in the ignition. I would also love to know the law to this in Victoria as my mates wanted to have a drink in the car and since I was driving to be on the safe side I told them not to.

    IMO we are all paranoid about this because we have all watched too many american cops shows because over in America the cops there seem to take this pretty serious. They call it 'open 'container' in the states. I don't watch cop shows, but I've heard that US cops aren't allowed to do random breath tests. So unless you're obviously drunk, you're unlikely to get pulled over. I like our system better, where everyone has a reasonable chance of getting checked from time to time.

    It IS illegal to consume alcohol in a motor vehicle for both passengers and the driver in WA. I can't provide proof right now it's 2am but if people don't want to take my word for it I can scan the pamphlet tomorrow.

    I was helping a friend move house, the proper movers ended up coming during beer break, ended up taking it with me. I'm still not sold on this. As far as I am aware, it is not because of the people drinking being in a vehicle but because it is a public place. I've seen three guys done at once in Northbridge for having a drink in a parked car before heading out.
